I had a great experience with Todd Miner Law Firm. I was in a car accident the beginning of 2026 and the team took over everything so I could focus on my journey to healing and recovery. Mr. Mark Ahrens and Stephanie Velez were such great help throughout the process. I hope I won’t have a need for them again, but if I did, I would not hesitate reaching out to them.
Excellent service will work with them again thank you Courtney
I have had the most positive experience working with Todd Miner after my car accident. Specifically, Mark Ahrens has been a major help to me, I couldn’t recommend them more. Thank you for supporting me through this process!
Today I had the opportunity to speak to Todd Minor and let me tell you this man knows his stuff. He was very transparent and gave me guidance that not even Morgan and Morgan could do. This man is very unique and seems very skilled if I were you, I would hire him immediately.
Mr Miner and his attorneys are the best ever so communicative Brandon and Evonne are phenomenal they are a professional law firm I would not choose no other!I am very happy;
really nice lawyer and very helpful
I highly recommend Todd Miner Law for any of your legal needs. From the moment I spoke with Mr. Miner on the phone and all the wonderful work done on my case by attorney Mark Ahrens Esq and his paralegal Stephanie, I know I was in good hands. They cared very much about my well-being and communicated that was above everything they were working on for me, was that I healed and became well from my car accident. No job too little or too small! I am very pleased working with this law firm for over a year too. I hope I don't need them in the future; however, if I do, I know I will be asking them to represent me again.
Todd was nice, he took the time to talk to me for 20 minutes or so to help guide me in the right direction, I was recently in a car accident and it’s not major, and I was practically clueless to the steps I should take. After talking to me I now know more than before. He was very helpful with information I may need for my situation.
Mark Ahrens and Stephanie Velez were splendid in handling my case. I was absolutely pleased with their sincere efforts in getting the right result.
I WAS TREATED WITH RESPECT AND IMPORTANCE. THAT MEANS A LOT TODAY! I RECIEVED THE MAX ALLOWED AND COULDNT HAVE GOTTEN ANY MORE ANYWHERE ELSE. THESE GUYS ARE TOP SHELF AND I HIGHLY RECOMMEND THEM! THE BEST AROUND, HANDS DOWN. IF I'M EVER IN NEED AGAIN, THEY'RE MY GUYS NOW! THANK YOU, TODD MINER LAW! THEY ALSO NETWORK ANIMALS IN NEED. LIKE US. GOTTA LOVE THAT HEART! ❤️
We were involved in an escalator accident in the Atlanta airport. I had seen the commercial quite a few times, but I was never in a situation where I needed one. Last night I was chatting about this online, which I thought was a bot. It was not just a bot. it was not, it was Attorney Miner himself. The chat was to go to the walk-in clinic for the pain and to call his office to speak with Elina after we were home. I spoke with Elina, and she couldn't have been more patient with me, and so sweet and wants to be sure she gets all the answers for us. Since our accident was in Georgia, we need to have an attorney in Georgia. Attorney Miner is going to make a personal call to an attorney in Georgia himself! When I was chatting last night, I asked who I was communicating with, and it was Attorney Miner himself. I hope I never need an attorney, but if I did or anyone I know, I will always refer to Attorney Miner. You will be in good hands with Elina! If we could give more stars, we would. Thank you, Attorney Miner and Elina!
After learning my car was deemed a total loss and the driver at fault did not have enough money in property damage to cover my claim, I truly believed I was going to be losing a significant amount of money for an accident I didn't cause. Todd Miner changed my perspective completely. Todd Miner is your person to guide you through auto accident claims and make sure you are getting what's rightfully owed to you. He personally assisted me in making sure I was asking the right questions and using the correct verbiage to ensure I wasn't being taken advantage of by any insurance policies involved. I had no idea I had other options to explore, but Todd provided super clear information on how to navigate these tricky insurance claims. He saved me $$$$ (no exaggeration) all while providing easy and stress-free interactions. Todd Miner Law values their clients like none other I've experienced. Thank you, Todd!
There are a lot of commercials out there for law offices that "care", or are "looking out for YOU"....let me tell you, Todd Miner is the real deal. I called at 3:30 on a Friday afternoon before a three day holiday weekend, because after being hit from behind by a driver who had trash for insurance, their insurance company as well as my own insurance company were pressuring me to quickly agree to items before the long holiday weekend, and none of the outcomes offered were remotely acceptable. Mr. Miner himself took my call after I gave details to his very friendly and compassionate associate, and for 35 minutes on a Friday afternoon when most people would be bolting out of the office for the holiday weekend, he gave me help when he had nothing to gain from it. Other firms we called either ignored us or blew us off because they didn't have anything to gain by taking our case. If I or anyone I knew needed a personal injury attorney, calling this law firm is the first phone call I would make.
I really appreciate that Todd personally took the time of day to speak with me on the particulars of my case and advise different avenues to pursue, thank you so much!
Thank you for Attorney, Mark and Stephanie for working on my case settlement. They had done a great job for me.
Thank you to Mark Aaron's and Ms Stephanie with my case. I was hit from behind by a car with minimal insurance. I wasn't looking for a bunch of money, I just wanted the doctors paid and it would make me happy. They took care of all the bills and I still got a check. I thank you again for all of the time spent on my case and talking to me. I give them 5 stars
Mark Ahrens was super helpful and helped me through the whole process as well as Stephanie, overall 5 stars treatment
Mark Ahrens was recommend by a friend to me. I appreciate that he took the time to answer my questions. He was also personable and friendly Great experience!
I would like to thank Attorney Todd Miner for handling the accident cases for both my wife and me. We truly appreciate everything he and his team have done for us. They kept in touch throughout the process and guided us every step of the way, making everything much easier to understand. If you ever need help with an auto accident case, I highly recommend Attorney Todd Miner.
I’m very grateful to Mark Ahrens and Stephanie Velez-Raghunandan at Todd Miner for their work on my hit-and-run case. From the beginning, they stayed persistent and didn’t give up, even when things weren’t straightforward. They kept me informed throughout the process and handled everything professionally. I truly appreciate their dedication and would recommend them to anyone needing reliable legal help.
I would like to take a moment to recognize Courtney Escoffery, Pre-Suit Paralegal at Todd Miner Law, for the outstanding service provided throughout my case. Although Courtney was assigned a couple of months into my case, the level of professionalism, communication, and consistency shown from the very beginning of our interaction was truly exceptional. Every question I had was addressed promptly, and I was kept informed with regular updates, which made the entire process feel smooth and reassuring. Courtney’s dedication and attention to detail made a significant difference in my experience. I always felt supported and confident knowing my case was in capable hands. From start to finish, the service provided was nothing short of phenomenal. I am sincerely grateful for the care and effort that was put into handling my case. Thank you for making what could have been a stressful experience feel manageable and well-handled.
I had an amazing experience with Todd Miner Law after my hit and run accident. From start to finish, they made the entire process smooth, stress free, and handled everything professionally. A special thank you to Mark Ahrens and Stephanie for always keeping me updated and making sure I understood every step. They truly care about their clients and go above and beyond to get the best results. Thanks to them, I was able to receive my settlement without any headaches. I highly recommend Todd Miner Law to anyone who needs a reliable and dedicated legal team. Thank you again for everything!
Mr Miner took his time with explaining my options, even though my case can't be helped. I will take that advise. Thank you.
Priya Ramrattan and the team at Todd Miner Law took great care of me during a very challenging time. They showed genuine respect and care for me during the time they were taking care of my legal representation. I would not hesitate to recommend them to anyone, or use them again should I ever need legal representation in the aftermath of an accident. Ed Vasconez
I would like to say thank you to Chris McGuire, Trenton Swan, and the rest of Todd Minor Law Firm team. Thanks to them I feel like my life is back on track where it was supposed to be before the accident. If I could give them 10 stars I would.
Good communication, and I had LOTS of questions. Chris was very patient, professional and knowledgeable. He made the whole process less traumatic. Well above a mere 5 stars.
Highly recommend this legal team! After the accident we were understandably overwhelmed, but working with this team made all the difference. They were responsive, organized, and truly dedicated from start to finish. Special shout out to Chris Mcquire and Todd Miner. Everyone was always professional, easy to reach, and incredibly supportive throughout the entire process. They made sure nothing fell through the cracks and kept everything moving smoothly. My family and I couldn’t be happier with the outcome. If you want a team that’s reliable, attentive, and gets results, this is the one to go with. Definitely a 5-star experience!
Excellent service! Very professional, attentive, and reliable. I highly recommend!
Excelente, me sentí muy cómodo!! Siempre me informaron sobre el caso hasta que llegó el final.
Five stars for Tod Miner Law! Ivonne was amazing to work with, she was extremely responsive and kept me informed every step of the way. They successfully got me the max settlement for my car. I’m very happy with the outcome and the level of service I received.
I texted him with a question and he called back in minutes. He took time to answer my question! He is a no- nonsense guy. Straight forward answers. If I ever need him I will hire him. Thanks
I was very impressed and happy with their handling of my case. Mr. Todd Miner called me back personally to discuss my options after I left a message on their voicemail. Mr. Mark Ahrens handled my account with empathy for me. Stephanie worked diligently on my case and medical bills. I cannot say enough good things about Todd Miner Law. If thank them for all their hard work on my behalf.
I was in an auto accident in January 2026. I contacted the Todd Miner law firm the same day of the accident. Within 5 minutes Todd Miner was on the phone with me and took almost 30 minutes out of his Saturday to speak to me about the accident. Following my conversation with Todd I had the opportunity to work with Mark Ahrens and Stephanie Velez and they went above and beyond to get everything taken care of. They answered all of my questions, kept me informed with updates, and streamlined the entire process in a way I wouldn't be able to do myself. Dealing with insurance companies can be a complex and difficult process that takes considerable time and effort. Mark and Stephanie handled everything and allowed me to focus on recovering from my injuries. I'm thankful for their help and while I hope to never be in another accident again, if I am, I wont hesitate to reach out to them again.
I simply went to Todd Miner's website and competed a text message on my situation. Todd (himself) called me and spent 20 minutes discussing my situation even though he isn't representing me. That is unbelievable that in today's society someone is actually willing to help and listen!! If there was a 10 star rating I would give it to him. Easily understood and the advice was solid. Thanks Todd for your time and help! It was truly needed.
Todd Minor is a stand up man, he's honest, fair, very protective of his clients and professional. I had a case with him regarding my minor & during the inquiry process he reached out himself multiple times assuring me that we would be in good hands & I'll just say this he himself holds good on his promises & commitment.
I was referred to Tod Minor Law by a friend of mine, and was very glad i followed through with them for my auto accident claim. Chris was the head communicator for my claim and arranged everything for my rehab and chiropractor appointments. highly reccomend!
I contacted this law office after I was involved in an accident, and I’m very glad I did. From the beginning, everyone was attentive and patient, taking the time to listen carefully to my situation. The paralegal, Stephanie, was especially kind and kept in regular communication with me throughout the process. Both she and the attorney, Mark, clearly explained what to expect, which helped ease my worries. Since this was my first injury case in Florida, their guidance made a big difference and allowed me to focus on my recovery. My case did take some time, but in the end, I was able to receive compensation for the accident. When I met Mark in person, he was a true gentleman who genuinely cares about his clients. I highly recommend this law office!
I am giving Todd Miner Law five stars – the most one can receive in these reviews. If it were possible, I would score his firm much higher, based on my personal experience with him and his team. Without going into great detail, I was struck by a car and my left leg was injured. After being treated at the local ER, along with other instructions, I was advised to follow-up with my Primary Care Physician. It was when I attempted to make that appointment that I quickly learned my doctor, and many others, will not treat vehicle accident patients. This made getting the treatment I needed after leaving the ER a struggle at best. That’s when I decided I needed help, and I reached out to Todd Miner’s office. In less than 30 minutes, Todd Miner himself called me. He listened to me and then told me he and his team would take good care of me … and they did. I think it was that afternoon that Mark Ahrens, Esq. reached out to me. In less than a week, thanks to their help and intervention, I was seen by a Physician who ordered the tests necessary to determine exactly what was wrong with my leg and what treatment I needed. Unfortunately, the test results showed surgery was required. Throughout this process, surgery, weeks of physical therapy, follow-up appointments, etc. Marc and his team were with me every step of the way. My well-being and recovery were as much a priority for them as it was for me. They consistently communicated with me - keeping me updated and informed as my case moved forward. I also have to commend Stephanie Velez-Raghunandan who works with Marc. She too was in constant communication with me and quick to respond to any questions or concerns I had. Todd Miner and his team exceeded my expectations. Calling his office was the best decision I could have made for myself and my family. I highly recommend Todd Miner Law. Todd and his team really are “on your side” and will take great care of you.
Hi, I have to say that Mark Ahrens and Stephanie, his assistant, were excellent helping me with my settlement. They fought hard for me for which I am grateful and I highly recommend them.
Stephanie and Mark were great. They worked extremely hard on my case and kept me informed every step of the way..
Trustworthy, honest, experienced. Communication at the start was lacking, but toward end it got better.
As a criminal defense lawyer who owns his own firm, I have referred many of my clients to Todd Miner who needed a personal injury attorney. Todd is an amazing lawyer and has an incredible staff. His office personnel is extremely friendly and professional. What I respect about Todd the most is I can text or call him on a Saturday afternoon, And he will immediately respond. He will call the potential clients himself right away and tell thoroughly evaluate their cases. I highly recommend him and his team of exceptionally talented lawyers and support staff!!!
Mark Ahrens at Todd Miner Law Firm was extremely knowledgeable, helpful, and professional throughout the entire process. He took the time to answer all of my questions thoroughly and made sure I understood every step. I truly appreciated his expertise and would highly recommend him to anyone in need of legal assistance.
My experience in March 2025 with Attorney Todd Miner was very good! His staff, Jennifer was always supportive and helpful, eager to answer questions or concerns. I would highly recommend this attorney office. Blessings continuously to this Attorney office and staff.
Thank you for helping me in the past with the employer who left me in the hospital injured, alone, and unwilling to take care of my hospital bills.
I am writing this review of Todd Miner Law so the public can get a perspective of an actual client’s experience following a car accident. My wife and I were hit by a driver resulting in our car rolling over two times. Medical questions aside, the trauma of the legal aspects after this accident were troubling. Being new to the state of Florida, we had no legal representation. One only has to watch television to see the various alternatives that are available to you. That being said, Todd Miner was the one that showed an interest in assisting us no matter what the possible outcome might be. To be honest, we were sort of lost in all the details that started to arise and needed help. Todd Miner came to the rescue. Attorney, Mark Aherns and his assistant, Stephanie Valez-Raghunandan were terrific in handling all the details that needed solved. My wife and I are grateful for their assistance; without them we would never have been able to reach this point of conclusion. Thank you, Todd, Mark, and Stephanie. We recommend them highly to anyone in need.

  • $850,000 Verdict: We won an $850,000 verdict for a family who tragically lost a loved one in a truck accident. By proving the trucking company’s negligence, we ensured they received the financial support needed for funeral expenses, lost wages, and the emotional impact caused by this tragic event.
  • $500,000 Settlement: Our team secured a $500,000 settlement for a client who was rear-ended by a truck. Despite facing opposition from the insurance company, we provided undeniable evidence to cover the client’s medical treatment, lost wages, and property damage, giving them the financial security to focus on their recovery.

Trucking companies and insurers have teams of lawyers. You deserve one too. Call Todd Miner Law at 407-894-1480 and work with trial attorneys with proven success against major trucking companies and insurers.

What Should You Do Immediately After a Truck Accident in Orlando?

First, call 911 to report the crash. Then, see a doctor, even if you think you’re okay, as some injuries take time to appear. Next, file a police report to document the incident. Before you leave the scene, make sure to collect evidence by taking photos and collecting contact information from the driver and any witnesses.

One wrong move after a truck accident can cost you. That’s why it’s important to speak with a trusted truck accident lawyer right away. At Todd Miner Law, we take over the stressful paperwork, deal directly with the insurance companies, and build a strong case focused on getting you the maximum compensation so you can fully focus on your recovery.

Mistakes That Can Hurt Your Truck Accident Case

What you do right after a truck accident can work for or against you. Insurance companies look for anything they can use to reduce or deny your claim. To protect yourself, you need to avoid the most common mistakes.

  • Leaving the scene before the police arrive. Always wait for law enforcement. If you leave early, your side of the story may never be recorded, and that can weaken your case.
  • Skipping medical treatment. Go to a doctor immediately. Even if you feel fine, internal injuries can go unnoticed without a medical exam. A delayed treatment gives insurers a reason to question your claim.
  • Admitting fault at the scene. Choose your words carefully. Saying something like “I’m sorry” may seem polite, but it can be used against you as an admission of guilt.
  • Failing to document the crash. Take clear photos of the vehicles, injuries, road conditions, and any damage. Without visual proof, it becomes harder to support your version of events.
  • Not collecting contact information. Get the truck driver’s name, license number, insurance details, and employer information. Speak with any witnesses and save their contact details as well.

Should You Speak to the Insurance Company Without a Lawyer?

It’s best to consult a truck injury lawyer before speaking with the insurance company. Insurance adjusters are skilled at getting statements that can minimize your claim. Even simple words can be twisted to reduce the payout or shift blame, potentially harming your case.

Here is why you should avoid speaking to insurers alone:

  • Misleading Statements: Insurance adjusters may distort your statements to make it seem like you share some responsibility or downplay the extent of your injuries, which can significantly harm your claim.
  • Pressure to Settle Quickly: They may offer a fast settlement that seems fair but rarely covers all your medical costs or lost wages in the long run.
  • Complex Legal Tactics: Insurers use complex tactics to pressure you into accepting less compensation. Without proper legal help, you risk being taken advantage of.

Don’t let the insurance company take control of your case. Speak with a truck accident attorney at Todd Miner Law before saying a word to them. Call 407-894-1480 for a free consultation and get the legal protection you need from day one.

Which Types of Trucks Are Most Likely to Cause Serious Accidents?

Truck accidents involve various types of vehicles, and some are more prone to crashes due to factors such as cargo size, road conditions, and operational limitations. Here are the types of trucks most often involved in accidents:

  • 18-Wheelers/Big Rigs: These large trucks are often involved in crashes due to their size, blind spots, and long stopping distances, especially on busy highways.
  • FedEx & Amazon Trucks: Delivery trucks like those from FedEx and Amazon often navigate crowded urban areas, increasing the risk of accidents due to tight spaces, frequent stops, and deadlines.
  • Tow Trucks: Due to their presence on busy roads and the nature of their work, tow trucks are more likely to be involved in accidents, especially when visibility is poor.
  • Refrigerated Trucks: These trucks carry perishable goods and can be prone to accidents if cooling systems fail or if the cargo is improperly loaded, affecting the vehicle’s stability.
  • Log Trucks: With heavy, unsecured loads of logs, these trucks often lead to accidents, including rollovers and blockages on the road if cargo falls off.
  • Flatbed Trucks: Flatbed trucks carrying unsecured or overhanging cargo are dangerous, as the load can shift, fall off, or create sudden hazards for other drivers.
  • Construction Trucks: These trucks often carry heavy equipment and materials, making them susceptible to tipping or losing cargo while driving.

How Our Truck Accident Lawyers Take On Amazon and FedEx Claims

Amazon and FedEx operate massive delivery fleets under strict deadlines. Their drivers often face pressure to meet quotas, leading to rushed routes, skipped inspections, and preventable crashes. When an accident occurs, these companies act fast to protect their bottom line, not your well-being.

That’s why it’s important to take action just as quickly. An experienced Orlando truck accident attorney can investigate the facts, preserve key evidence, and build a case that holds every party accountable.

At Todd Miner Law, our team knows how to challenge corporate fleets and hold them responsible for the damages they have caused you. Here’s what we do:

  • First, we review driver logs, training records, and dispatch schedules.
  • Then, we analyze black box data and delivery routes.
  • We investigate maintenance records and safety inspection history.
  • We identify any violations of federal safety rules.
  • Finally, we determine every liable party, including third-party contractors.

Amazon and FedEx act fast after a crash to limit their responsibility. If you wait, critical evidence can disappear, and your case may lose value. At Todd Miner Law, we move quickly to protect your rights and build a case that stands up to corporate carriers. Call 407-894-1480 today to get the help you need.

Who Can Be Held Liable in a Truck Accident?

Liability in a truck accident often extends beyond just the driver or the trucking company. Other parties, such as truck manufacturers, maintenance providers, and loading companies, may also share responsibility if defective parts, poor maintenance, or improper loading contributed to the crash.

Identifying fault in a truck accident is often challenging and requires a thorough legal investigation to uncover the full extent of liability. At Todd Miner Law, we conduct detailed investigations, recognize all responsible parties, and build a strong case focused on securing the full compensation you deserve. Call 407-894-1480 today to speak with our experienced Orlando truck accident attorneys and protect your rights.

What Happens When a Truck Defect Causes a Crash?

If a defective part or design flaw caused the crash, the manufacturer or supplier may be held liable. Common examples include faulty brakes, tire blowouts, and steering malfunctions that lead to loss of control or impact.

These cases often fall under product liability law. Your attorney will investigate vehicle records, recall history, and expert reports to determine whether a defective component caused or contributed to the accident. Unlike driver negligence, this type of fault requires proving that the part was unreasonably dangerous and directly caused the crash.

How Do Truck Accident Lawyers Determine Who Is Responsible for a Truck Crash?

Responsibility is determined by investigating every factor that contributed to the crash. This includes reviewing black box data, driver logs, maintenance records, and witness statements to identify which parties — such as the driver, trucking company, or contractors — played a role.

At Todd Miner Law, we conduct comprehensive investigations to uncover the truth. Our team works with accident reconstruction experts and industry specialists to build a clear timeline of what happened and why. This process ensures we pursue the right parties and secure the compensation you deserve.

Is the Trucking Company Always Responsible for the Driver’s Actions?

Not always. A trucking company is typically liable for accidents caused by its drivers if the driver was on duty and acting within the scope of employment. However, exceptions exist.

For instance, if the driver was operating outside company guidelines or was classified as an independent contractor, the company may try to deny responsibility. Your attorney will review contracts, company policies, and work history to determine whether the employer can be held accountable under vicarious liability laws.

Can a Shipping or Loading Company Be Liable for a Truck Accident?

Yes. If a crash results from improperly loaded or unsecured cargo, the shipping or loading company can be held liable for negligence. This often applies to third-party logistics providers or warehouse teams.

Poor weight distribution, unbalanced loads, or unrestrained materials can cause a truck to roll over, jackknife, or spill debris. Lawyers will examine shipping logs, load manifests, and driver statements to trace responsibility. These companies are often overlooked but can play a critical role in causing a crash.

When multiple parties are involved, liability gets complicated, and evidence disappears fast. That’s why our team at Todd Miner Law moves quickly to investigate, protect your case, and pursue full compensation. Call 407-894-1480 now to get the answers you need before the defense builds theirs.

What Compensation Can You Recover After a Truck Accident?

After a truck accident, you have the right to recover compensation for both financial and emotional losses. Understanding your entitlements ensures you can claim everything you deserve. Let’s break down each category, including additional damages, to help ease the burden after a serious truck accident.

Economic Damages

Economic damages compensate you for actual, out-of-pocket expenses caused by the accident. These are losses you can measure with bills, pay stubs, and receipts. Since these financial damages can add up quickly, documenting them early helps protect your rights and ensures you claim every eligible cost.

  • Medical Expenses

Medical expenses often become your biggest concern immediately after a truck accident. You can recover costs for emergency care, surgeries, and rehabilitation. Additionally, expenses for future treatments qualify, but you’ll need medical records and expert opinions confirming that future care is necessary. Therefore, keep every receipt and document to support your full claim.

  • Lost Wages and Loss of Earning Capacity

If you’ve missed work, you’re entitled to recover lost wages. This includes your salary, overtime, and bonuses. Even sick leave and vacation days count. Moreover, if your injuries limit future job opportunities, you can claim lost earning capacity. In short,  this type of compensation covers both your current and potential future financial losses.

  • Property Damage

After a truck accident, vehicle repairs or replacements are often costly. Not only can you recover those costs, but you can also claim personal property damaged in the crash. Furthermore, your vehicle’s resale value may drop after repairs. Fortunately, you’re allowed to pursue compensation for this diminished value as well.

  • Other Related Expenses

Beyond medical bills and vehicle repairs, truck accidents bring unexpected expenses. For example, you might need home care, childcare, or temporary transportation. Additionally, essential home modifications like wheelchair ramps are recoverable. By carefully tracking these costs, you protect your right to full compensation for every accident-related out-of-pocket expense.

Non-Economic Damages

While economic damages cover your financial losses, non-economic damages address the emotional and psychological impact of the accident. These damages reflect how your quality of life has been significantly affected by your injuries.

  • Pain and Suffering

You can recover compensation for the physical pain and discomfort caused by your injuries. This includes immediate and ongoing pain that disrupts your daily life. Moreover, these damages cover both short-term and long-term suffering, including chronic pain, sleep issues, and mobility problems that limit your comfort and independence.

  • Mental Anguish

Truck accidents don’t just harm your body; they affect your mind. Compensation for mental anguish addresses emotional distress like PTSD, anxiety, and depression. Even simple tasks might trigger fear or panic. Therapy records and personal statements help support these claims and show how deeply your life has changed emotionally.

  • Loss of Consortium

When injuries strain your marriage or partnership, you can claim loss of consortium. Therefore, this category compensates for lost companionship, affection, and intimacy after a serious accident. In addition, it acknowledges how your relationship’s emotional and physical bond suffers, impacting your and your spouse’s daily lives and future together.

  • Loss of Enjoyment of Life

A truck accident can rob you of the activities and hobbies that once brought you joy. As a result, your daily routine and sense of fulfillment may be significantly impacted. This type of compensation recognizes how accidents often take away meaningful parts of your routine.

  • Disfigurement and Scarring

Permanent scars and disfigurement affect both your appearance and mental health. Compensation addresses the lasting emotional, physical, and social impact. Moreover, these damages consider how visible injuries lower confidence, cause social anxiety, and influence daily interactions, whether at work or in personal relationships, long after recovery begins.

Additional Considerations

In some instances, there are additional factors to consider when calculating compensation. These damages may not be typical, but can significantly increase the amount you recover. Here’s what to know about these potential claims.

  • Punitive Damages

Punitive damages aim to punish particularly reckless or malicious behavior, such as driving under the influence or gross negligence. These damages serve to deter future misconduct. In addition, punitive damages reflect the severity of the defendant’s actions and can significantly increase the overall compensation.

  • Wrongful Death

If a loved one dies due to a truck accident, surviving family members can seek compensation for their loss. This includes loss of companionship, future support, and funeral expenses. The wrongful death claim provides financial assistance for the emotional and financial void left by the deceased, helping the family cope with the aftermath.

  • Diminished Value

If your vehicle is repaired after the accident, its resale value might be reduced. Even after repairs, the history of the accident can lower your car’s worth. Therefore, you have the right to claim this difference in value as part of your property damage settlement.

What Is the Average Truck Accident Settlement in Florida?

Most truck accident settlements in Florida range from $150,000 to $1 million, but your final payout will depend on the details of your case. The severity of your injuries, how they affect your ability to work, and the level of fault assigned to each party all play important roles.

For instance, minor injuries like whiplash might result in a smaller settlement, while more serious injuries, such as a traumatic brain injury, could lead to a much larger payout. Since every case is unique, understanding these factors is crucial. Consulting with an experienced attorney ensures you’re fully informed and able to pursue the compensation you deserve.

Common Settlement Ranges Based on Injury Severity

To give you a clearer picture, here’s what you could typically recover if you’re injured in a truck accident in Florida:

Type of InjuryTypical Settlement RangeWhat’s Included
Minor Injuries$15,000 – $50,000Covers short-term medical care, quick recovery, and minor expenses.
Moderate Injuries$50,000 – $200,000Pays for fractures, outpatient surgery, missed work, and follow-ups.
Serious Injuries$250,000 – $750,000Includes rehab, multiple surgeries, long-term care, and lost wages.
Catastrophic Injuries$1 million – $5 million+Covers permanent disabilities, life care plans, and future income loss.
Wrongful Death$500,000 – $5 million+Provides for family loss, income replacement, and emotional damages.

What Affects Your Truck Accident Settlement Amount?

Several key factors directly impact how much money you could receive after a truck crash in Florida. These may include:

  • Severity of Injuries

The extent of your injuries plays a pivotal role in determining your settlement amount. Severe injuries often lead to higher medical expenses, longer recovery times, and increased compensation.

For instance, traumatic brain injuries or spinal cord damage can result in settlements ranging from hundreds of thousands to millions of dollars, reflecting the long-term impact on your life.

  • Impact on Earning Capacity

If your injuries prevent you from working or reduce your ability to earn in the future, your settlement should account for lost wages and diminished earning potential. This includes not only current income loss but also future earnings, promotions, and benefits you might miss due to the accident.

  • Insurance Policy Limits

The at-fault party’s insurance coverage sets a ceiling on the compensation available. If damages exceed these limits, recovering the full amount may be challenging. In such cases, exploring additional avenues like underinsured motorist coverage or pursuing the defendant’s personal assets might be necessary.

  • Property Damage and Diminished Value

Beyond repair costs, you can claim for diminished value—the reduction in your vehicle’s market value post-accident. This is recognized in Florida and can be a significant component of your claim, especially if your vehicle was relatively new or had a high resale value before the accident.

  • Evidence and Documentation

Strong evidence, including medical records, accident reports, and witness statements, strengthens your claim. Therefore, comprehensive documentation can lead to a more favorable settlement. Additionally, photographs of the accident scene, vehicle damage, and injuries can provide compelling visual proof to support your case.

  • Pre-Existing Conditions

Pre-existing medical conditions can complicate the determination of settlement value in truck accident cases. Insurance companies may argue that your injuries were not solely caused by the accident but were exacerbated by pre-existing conditions. Therefore, it is important to differentiate between the impact of the accident and any prior health issues.

  • Liability Distribution Among Multiple Parties

When liability is distributed among multiple parties, including the driver, the trucking company, and the cargo loader, the final settlement amount could be affected. The value of a claim depends heavily on relevant evidence, such as medical records, driver logs, and black box data.

Why Florida’s Comparative Negligence Law Matters

Florida follows a modified comparative negligence system, which directly affects how much compensation you can claim after a truck accident. If you’re found partially at fault, your settlement decreases by that exact percentage. For example, being 30% responsible means losing 30% of your payout.

However, here’s the critical part: if you’re more than 50% at fault, you lose the right to collect compensation from the other party entirely. This makes proving the truck driver’s or trucking company’s negligence essential.

Every truck accident case is unique, which is why you need a legal team that understands how to maximize your compensation. At Todd Miner Law, we meticulously analyze every detail, collaborate with top experts, and fight relentlessly to ensure you receive the full compensation you’re entitled to. How Long Do You Have to File a Truck Accident Claim in Orlando, Florida?

In Florida, you generally have two years from the date of the truck accident to file a personal injury lawsuit under Florida Statutes § 95.11(3)(o). This deadline applies whether the accident involved minor or severe injuries. It’s essential to file within this time frame, or you risk losing your chance of pursuing compensation.

Consequences of Missing the Deadline

If you miss the two-year deadline to file a truck accident lawsuit in Florida, you lose your legal right to seek compensation. This deadline is strict, and once it passes, the court will likely refuse to hear your case, no matter how serious your injuries are. Here’s what could happen:

  • No compensation: You won’t be able to recover compensation for your medical bills, lost wages, or pain and suffering. Consequently, this could leave you with mounting costs and no way to cover them.
  • Case dismissal: The court is likely to dismiss your case outright if you file after the two-year deadline has passed. Once dismissed, it becomes much harder to seek any recovery for your injuries.
  • Loss of evidence: Evidence critical to your case may disappear over time. For example, important physical evidence may deteriorate, and witnesses may forget key details, making it more difficult to prove fault.

When you delay taking action, you risk losing your right to compensation. A truck injury lawyer can help ensure you meet all necessary deadlines and guide you through the process with confidence.

Are There Any Exceptions?

Though the two-year statute of limitations is the general rule, there are several exceptions to filing your truck accident claim. Here’s a closer look at them:

  • Wrongful death: If the truck accident caused the death of a loved one, the two-year statute of limitations begins from the date of death, not from the accident date. This exception gives grieving families time to cope while still ensuring that legal action is pursued.
  • Discovery Rule: If the injury or damages weren’t immediately apparent after the accident, the statute of limitations may start from the date the injury or damage was reasonably discovered. For instance, if you didn’t realize the full extent of your injuries immediately, the clock may begin ticking when the issue is discovered.
  • Minors or Legally Incapacitated: If the accident victim is a minor or legally incapacitated, the statute of limitations may be extended. The time limit is paused until the individual reaches adulthood or is no longer incapacitated, allowing more time for legal action.
  • Defendant Leaving the State: If the defendant (such as the truck driver or trucking company) leaves Florida, the statute of limitations may be paused. The clock doesn’t continue to run while the defendant is out of state, allowing the injured party more time to file a claim.

These exceptions can be complex, and it’s essential to have an experienced truck accident law firm on your side to help you understand how these rules may apply to your case. At Todd Miner Law, our best truck accident lawyer can help guide you through these details, ensuring you don’t miss any critical deadlines.

Why You Should Act Fast?

After a truck accident, every minute counts. Waiting too long can seriously damage your chances of securing the compensation you deserve. Florida’s truck accident laws are strict about deadlines, and the longer you delay, the harder it gets to protect your claim.

Here’s why moving quickly matters:

  • Faster Access to Evidence

Evidence is critical for winning truck accident settlements in Florida. Over time, photos get lost, records disappear, and physical damage is repaired. Valuable proof that could support your truck accident lawsuit won’t be available forever.

  • Witness Availability

Witnesses play a huge role in proving fault. As weeks and months pass, people move away or forget important details. Their testimony could mean the difference between a denied claim and fair compensation for truck accident injuries.

  • Avoid Lowball Settlement Offers

Insurance companies quickly offer low settlements when you delay. Therefore, acting fast with a truck injury lawyer protects your rights, strengthens your case, and ensures you aren’t pressured into unfair compensation.

  • Stronger Negotiations Happen Early

When you act fast, your truck injury lawyer has more time and evidence to build leverage. This pressure forces insurance companies to offer better truck accident settlements in Florida instead of lowballing you later.

At Todd Miner Law, we review every detail, uncover hidden timelines, and take quick action to protect your rights. With decades of experience in Florida truck accident cases, our truck accident attorneys fight aggressively to protect your rights and maximize your recovery. What If I Was Hit by a Truck as a Pedestrian or Cyclist?

Being involved in a truck accident as a pedestrian or cyclist can be life-changing, leaving you with serious injuries, significant medical bills, and emotional distress. Unlike accidents between motor vehicles, these collisions often involve severe physical consequences because pedestrians and cyclists are especially vulnerable to injury when struck by large trucks. Therefore, if this has happened to you, it’s crucial to understand your rights and how the legal process works in Florida.

What to Do After Being Hit by a Truck as a Pedestrian or Cyclist?

If you’ve been involved in a truck accident as a pedestrian or cyclist, the steps you take immediately after the accident can significantly impact your ability to secure compensation. Here’s what you should do:

  1. Get Medical Help Immediately: Even if you feel okay, it’s essential to seek medical attention right away. Some injuries, such as internal bleeding or concussions, may not be immediately obvious but can be life-threatening. Prompt treatment also helps document your injuries for your claim.
  2. Call the Police: Always report the accident to law enforcement. The police will document the scene, speak with witnesses, and create an official report that will be invaluable when pursuing your claim.
  3. Gather Evidence: If you are able to do so safely, take photos of the accident scene, including vehicle damage, road conditions, and any visible injuries. Moreover, if there are skid marks, traffic signs, or damaged property, photograph those as well.
  4. Get Witness Information: Witnesses can be critical to proving fault in your case. Therefore, make sure to collect their contact information, including names, phone numbers, and statements if possible.
  5. Contact a Skilled Truck Accident Lawyer: After a truck accident, having a qualified attorney by your side can make all the difference. They will help you gather evidence, investigate the scene, and ensure that your rights are protected. Additionally, a lawyer specializing in truck accidents will understand the intricacies of Florida’s laws and can guide you through the process of filing a claim.

FAQs - Truck Accident Lawyer Orlando

Yes, you can sue a trucking company directly if their actions contributed to the accident. This may include negligence in poor maintenance, improper hiring, or failing to enforce safety regulations. In addition, even if the truck driver was primarily at fault, the company can still be held liable for its role in the accident.

Even if the truck driver is an independent contractor, the trucking company may still be liable. This becomes especially true when the company neglects to enforce safety standards or fails to properly train or supervise its drivers, leading to the crash. Furthermore, the company’s liability will depend on the specific circumstances surrounding the accident.

Insurance companies often prioritize their profits and may offer lower settlements than you deserve. They may downplay the severity of your injuries or try to minimize their liability. Therefore, having an experienced attorney helps ensure you receive a fair settlement that fully covers your damages and lost wages.

The time to resolve a truck accident case depends on several factors. These include the complexity of the case, whether fault is disputed, and the need for expert witnesses. Some cases may settle within a few months, while more complex cases could take over a year.  Furthermore, if the case goes to trial, it may take longer to conclude.

Investigators determine fault in a truck accident by closely examining key evidence, such as police reports, witness statements, and data from the truck’s black box. In addition, they evaluate the driver’s behavior, road conditions, and the trucking company’s safety policies. In some cases, they rely on expert testimony to reconstruct the accident and determine responsibility for the crash.

Yes, you can sue the trucking company if their negligence contributed to your injuries. This may include improper maintenance of the vehicle, failure to train drivers properly, or violating federal regulations. The trucking company may hold liability for its role in causing the accident, even if the driver was at fault.

If the truck driver is an independent contractor, the trucking company may still be held responsible under certain circumstances. For example, if the company failed to ensure safety practices or negligently supervised the driver, they can be held liable. Furthermore, independent contractors must still adhere to company policies and regulations that impact public safety.

The duration of a truck accident lawsuit can vary significantly. Simple cases may resolve in a few months. However, more complex cases with severe injuries or multiple parties can take over a year. Factors such as the need for investigations and expert testimony can affect the timeline. Additionally, settlement negotiations also impact how long it will take to reach a resolution.

A FedEx truck accident differs significantly from a typical car accident due to the involvement of a large commercial vehicle operated by a major corporation. These trucks are subject to federal regulations, and accidents often involve complex factors such as driver fatigue, vehicle maintenance issues, and cargo loading practices. Additionally, determining liability can be more complicated, as multiple parties—including the driver, FedEx, and third-party contractors—may share responsibility. Given these complexities, it’s crucial to consult with an attorney experienced in commercial vehicle accidents to navigate the legal process effectively.

Common causes of truck accidents include driver fatigue, distracted driving, speeding, and poor vehicle maintenance. Additionally, weather conditions, improperly loaded cargo, and failure to adhere to federal regulations can also contribute to crashes. Furthermore, in some cases, mechanical failure or reckless driving by other road users may play a role in causing truck accidents.

Yes, you can claim compensation for emotional distress following a truck accident, especially if the emotional toll is significant. This may include conditions such as anxiety, depression, or post-traumatic stress disorder (PTSD). However, you must demonstrate how the accident impacted your mental well-being to recover compensation for emotional distress. Often, this requires the support of a medical professional who can provide the necessary documentation and testimony to strengthen your claim.

If the insurance adjuster contacts you, avoid giving a statement or accepting a settlement offer without consulting an attorney. Insurance adjusters often attempt to downplay your injuries or pressure you into accepting a quick, unfair settlement. In this situation, having an attorney can protect your rights and ensure that you receive full compensation for your damages. By consulting a lawyer, you can make informed decisions and avoid costly mistakes.

Yes, truck drivers must follow regulations set by the Federal Motor Carrier Safety Administration (FMCSA). It includes rules about driver hours, vehicle maintenance, and cargo handling. These regulations aim to ensure road safety by limiting driver fatigue, maintaining vehicle roadworthiness, and promoting safe transport. Therefore, any violation of these rules can significantly contribute to accidents, endangering both the driver and others on the road.

A spoliation letter is a formal notice that requests the responsible party to preserve crucial evidence for your case. Specifically, it instructs them to retain important documents and physical evidence, like truck driver logs, dashcam footage, or maintenance records, to ensure they don’t destroy or alter anything. As a result, you not only protect your claim but also ensure that vital evidence remains available. Ultimately, this helps you build a stronger case.

You should not accept the insurance company’s first settlement offer without careful consideration. Often, these initial offers are lower than what you deserve. Instead, review your case with a truck accident lawyer to ensure you’re fully compensated for medical bills, lost wages, and pain. Only settle when the offer truly reflects your losses.

Yes, if you’re injured by a dump truck at a worksite, you may be eligible for workers’ compensation benefits, which cover medical care and wage replacement, regardless of fault. However, if a third party, such as a negligent driver or equipment manufacturer, contributed to the accident, you could also pursue a personal injury lawsuit for additional compensation. In such cases, it’s highly recommended to consult with a personal injury attorney who can help you explore all potential avenues for compensation and ensure that your rights are fully protected.
