I had a great experience with Todd Miner Law Firm. I was in a car accident the beginning of 2026 and the team took over everything so I could focus on my journey to healing and recovery. Mr. Mark Ahrens and Stephanie Velez were such great help throughout the process. I hope I won’t have a need for them again, but if I did, I would not hesitate reaching out to them.
Excellent service will work with them again thank you Courtney
I have had the most positive experience working with Todd Miner after my car accident. Specifically, Mark Ahrens has been a major help to me, I couldn’t recommend them more. Thank you for supporting me through this process!
Today I had the opportunity to speak to Todd Minor and let me tell you this man knows his stuff. He was very transparent and gave me guidance that not even Morgan and Morgan could do. This man is very unique and seems very skilled if I were you, I would hire him immediately.
Mr Miner and his attorneys are the best ever so communicative Brandon and Evonne are phenomenal they are a professional law firm I would not choose no other!I am very happy;
really nice lawyer and very helpful
I highly recommend Todd Miner Law for any of your legal needs. From the moment I spoke with Mr. Miner on the phone and all the wonderful work done on my case by attorney Mark Ahrens Esq and his paralegal Stephanie, I know I was in good hands. They cared very much about my well-being and communicated that was above everything they were working on for me, was that I healed and became well from my car accident. No job too little or too small! I am very pleased working with this law firm for over a year too. I hope I don't need them in the future; however, if I do, I know I will be asking them to represent me again.
Todd was nice, he took the time to talk to me for 20 minutes or so to help guide me in the right direction, I was recently in a car accident and it’s not major, and I was practically clueless to the steps I should take. After talking to me I now know more than before. He was very helpful with information I may need for my situation.
Mark Ahrens and Stephanie Velez were splendid in handling my case. I was absolutely pleased with their sincere efforts in getting the right result.
I WAS TREATED WITH RESPECT AND IMPORTANCE. THAT MEANS A LOT TODAY! I RECIEVED THE MAX ALLOWED AND COULDNT HAVE GOTTEN ANY MORE ANYWHERE ELSE. THESE GUYS ARE TOP SHELF AND I HIGHLY RECOMMEND THEM! THE BEST AROUND, HANDS DOWN. IF I'M EVER IN NEED AGAIN, THEY'RE MY GUYS NOW! THANK YOU, TODD MINER LAW! THEY ALSO NETWORK ANIMALS IN NEED. LIKE US. GOTTA LOVE THAT HEART! ❤️
We were involved in an escalator accident in the Atlanta airport. I had seen the commercial quite a few times, but I was never in a situation where I needed one. Last night I was chatting about this online, which I thought was a bot. It was not just a bot. it was not, it was Attorney Miner himself. The chat was to go to the walk-in clinic for the pain and to call his office to speak with Elina after we were home. I spoke with Elina, and she couldn't have been more patient with me, and so sweet and wants to be sure she gets all the answers for us. Since our accident was in Georgia, we need to have an attorney in Georgia. Attorney Miner is going to make a personal call to an attorney in Georgia himself! When I was chatting last night, I asked who I was communicating with, and it was Attorney Miner himself. I hope I never need an attorney, but if I did or anyone I know, I will always refer to Attorney Miner. You will be in good hands with Elina! If we could give more stars, we would. Thank you, Attorney Miner and Elina!
After learning my car was deemed a total loss and the driver at fault did not have enough money in property damage to cover my claim, I truly believed I was going to be losing a significant amount of money for an accident I didn't cause. Todd Miner changed my perspective completely. Todd Miner is your person to guide you through auto accident claims and make sure you are getting what's rightfully owed to you. He personally assisted me in making sure I was asking the right questions and using the correct verbiage to ensure I wasn't being taken advantage of by any insurance policies involved. I had no idea I had other options to explore, but Todd provided super clear information on how to navigate these tricky insurance claims. He saved me $$$$ (no exaggeration) all while providing easy and stress-free interactions. Todd Miner Law values their clients like none other I've experienced. Thank you, Todd!
There are a lot of commercials out there for law offices that "care", or are "looking out for YOU"....let me tell you, Todd Miner is the real deal. I called at 3:30 on a Friday afternoon before a three day holiday weekend, because after being hit from behind by a driver who had trash for insurance, their insurance company as well as my own insurance company were pressuring me to quickly agree to items before the long holiday weekend, and none of the outcomes offered were remotely acceptable. Mr. Miner himself took my call after I gave details to his very friendly and compassionate associate, and for 35 minutes on a Friday afternoon when most people would be bolting out of the office for the holiday weekend, he gave me help when he had nothing to gain from it. Other firms we called either ignored us or blew us off because they didn't have anything to gain by taking our case. If I or anyone I knew needed a personal injury attorney, calling this law firm is the first phone call I would make.
I really appreciate that Todd personally took the time of day to speak with me on the particulars of my case and advise different avenues to pursue, thank you so much!
Thank you for Attorney, Mark and Stephanie for working on my case settlement. They had done a great job for me.
Thank you to Mark Aaron's and Ms Stephanie with my case. I was hit from behind by a car with minimal insurance. I wasn't looking for a bunch of money, I just wanted the doctors paid and it would make me happy. They took care of all the bills and I still got a check. I thank you again for all of the time spent on my case and talking to me. I give them 5 stars
Mark Ahrens was super helpful and helped me through the whole process as well as Stephanie, overall 5 stars treatment
Mark Ahrens was recommend by a friend to me. I appreciate that he took the time to answer my questions. He was also personable and friendly Great experience!
I would like to thank Attorney Todd Miner for handling the accident cases for both my wife and me. We truly appreciate everything he and his team have done for us. They kept in touch throughout the process and guided us every step of the way, making everything much easier to understand. If you ever need help with an auto accident case, I highly recommend Attorney Todd Miner.
I’m very grateful to Mark Ahrens and Stephanie Velez-Raghunandan at Todd Miner for their work on my hit-and-run case. From the beginning, they stayed persistent and didn’t give up, even when things weren’t straightforward. They kept me informed throughout the process and handled everything professionally. I truly appreciate their dedication and would recommend them to anyone needing reliable legal help.
I would like to take a moment to recognize Courtney Escoffery, Pre-Suit Paralegal at Todd Miner Law, for the outstanding service provided throughout my case. Although Courtney was assigned a couple of months into my case, the level of professionalism, communication, and consistency shown from the very beginning of our interaction was truly exceptional. Every question I had was addressed promptly, and I was kept informed with regular updates, which made the entire process feel smooth and reassuring. Courtney’s dedication and attention to detail made a significant difference in my experience. I always felt supported and confident knowing my case was in capable hands. From start to finish, the service provided was nothing short of phenomenal. I am sincerely grateful for the care and effort that was put into handling my case. Thank you for making what could have been a stressful experience feel manageable and well-handled.

A special thank you to Mark Ahrens and Stephanie for always keeping me updated and making sure I understood every step. They truly care about their clients and go above and beyond to get the best results. Thanks to them, I was able to receive my settlement without any headaches. I highly recommend Todd Miner Law to anyone who needs a reliable and dedicated legal team. Thank you again for everything!
Mr Miner took his time with explaining my options, even though my case can't be helped. I will take that advise. Thank you.
Priya Ramrattan and the team at Todd Miner Law took great care of me during a very challenging time. They showed genuine respect and care for me during the time they were taking care of my legal representation. I would not hesitate to recommend them to anyone, or use them again should I ever need legal representation in the aftermath of an accident. Ed Vasconez
I would like to say thank you to Chris McGuire, Trenton Swan, and the rest of Todd Minor Law Firm team. Thanks to them I feel like my life is back on track where it was supposed to be before the accident. If I could give them 10 stars I would.
Good communication, and I had LOTS of questions. Chris was very patient, professional and knowledgeable. He made the whole process less traumatic. Well above a mere 5 stars.
Highly recommend this legal team! After the accident we were understandably overwhelmed, but working with this team made all the difference. They were responsive, organized, and truly dedicated from start to finish. Special shout out to Chris Mcquire and Todd Miner. Everyone was always professional, easy to reach, and incredibly supportive throughout the entire process. They made sure nothing fell through the cracks and kept everything moving smoothly. My family and I couldn’t be happier with the outcome. If you want a team that’s reliable, attentive, and gets results, this is the one to go with. Definitely a 5-star experience!
Excellent service! Very professional, attentive, and reliable. I highly recommend!
Excelente, me sentí muy cómodo!! Siempre me informaron sobre el caso hasta que llegó el final.
Five stars for Tod Miner Law! Ivonne was amazing to work with, she was extremely responsive and kept me informed every step of the way. They successfully got me the max settlement for my car. I’m very happy with the outcome and the level of service I received.
I texted him with a question and he called back in minutes. He took time to answer my question! He is a no- nonsense guy. Straight forward answers. If I ever need him I will hire him. Thanks
I was very impressed and happy with their handling of my case. Mr. Todd Miner called me back personally to discuss my options after I left a message on their voicemail. Mr. Mark Ahrens handled my account with empathy for me. Stephanie worked diligently on my case and medical bills. I cannot say enough good things about Todd Miner Law. If thank them for all their hard work on my behalf.
I was in an auto accident in January 2026. I contacted the Todd Miner law firm the same day of the accident. Within 5 minutes Todd Miner was on the phone with me and took almost 30 minutes out of his Saturday to speak to me about the accident. Following my conversation with Todd I had the opportunity to work with Mark Ahrens and Stephanie Velez and they went above and beyond to get everything taken care of. They answered all of my questions, kept me informed with updates, and streamlined the entire process in a way I wouldn't be able to do myself. Dealing with insurance companies can be a complex and difficult process that takes considerable time and effort. Mark and Stephanie handled everything and allowed me to focus on recovering from my injuries. I'm thankful for their help and while I hope to never be in another accident again, if I am, I wont hesitate to reach out to them again.
I simply went to Todd Miner's website and competed a text message on my situation. Todd (himself) called me and spent 20 minutes discussing my situation even though he isn't representing me. That is unbelievable that in today's society someone is actually willing to help and listen!! If there was a 10 star rating I would give it to him. Easily understood and the advice was solid. Thanks Todd for your time and help! It was truly needed.
Todd Minor is a stand up man, he's honest, fair, very protective of his clients and professional. I had a case with him regarding my minor & during the inquiry process he reached out himself multiple times assuring me that we would be in good hands & I'll just say this he himself holds good on his promises & commitment.
I was referred to Tod Minor Law by a friend of mine, and was very glad i followed through with them for my auto accident claim. Chris was the head communicator for my claim and arranged everything for my rehab and chiropractor appointments. highly reccomend!
I contacted this law office after I was involved in an accident, and I’m very glad I did. From the beginning, everyone was attentive and patient, taking the time to listen carefully to my situation. The paralegal, Stephanie, was especially kind and kept in regular communication with me throughout the process. Both she and the attorney, Mark, clearly explained what to expect, which helped ease my worries. Since this was my first injury case in Florida, their guidance made a big difference and allowed me to focus on my recovery. My case did take some time, but in the end, I was able to receive compensation for the accident. When I met Mark in person, he was a true gentleman who genuinely cares about his clients. I highly recommend this law office!
I am giving Todd Miner Law five stars – the most one can receive in these reviews. If it were possible, I would score his firm much higher, based on my personal experience with him and his team. Without going into great detail, I was struck by a car and my left leg was injured. After being treated at the local ER, along with other instructions, I was advised to follow-up with my Primary Care Physician. It was when I attempted to make that appointment that I quickly learned my doctor, and many others, will not treat vehicle accident patients. This made getting the treatment I needed after leaving the ER a struggle at best. That’s when I decided I needed help, and I reached out to Todd Miner’s office. In less than 30 minutes, Todd Miner himself called me. He listened to me and then told me he and his team would take good care of me … and they did. I think it was that afternoon that Mark Ahrens, Esq. reached out to me. In less than a week, thanks to their help and intervention, I was seen by a Physician who ordered the tests necessary to determine exactly what was wrong with my leg and what treatment I needed. Unfortunately, the test results showed surgery was required. Throughout this process, surgery, weeks of physical therapy, follow-up appointments, etc. Marc and his team were with me every step of the way. My well-being and recovery were as much a priority for them as it was for me. They consistently communicated with me - keeping me updated and informed as my case moved forward. I also have to commend Stephanie Velez-Raghunandan who works with Marc. She too was in constant communication with me and quick to respond to any questions or concerns I had. Todd Miner and his team exceeded my expectations. Calling his office was the best decision I could have made for myself and my family. I highly recommend Todd Miner Law. Todd and his team really are “on your side” and will take great care of you.
Hi, I have to say that Mark Ahrens and Stephanie, his assistant, were excellent helping me with my settlement. They fought hard for me for which I am grateful and I highly recommend them.
Stephanie and Mark were great. They worked extremely hard on my case and kept me informed every step of the way..
Trustworthy, honest, experienced. Communication at the start was lacking, but toward end it got better.
As a criminal defense lawyer who owns his own firm, I have referred many of my clients to Todd Miner who needed a personal injury attorney. Todd is an amazing lawyer and has an incredible staff. His office personnel is extremely friendly and professional. What I respect about Todd the most is I can text or call him on a Saturday afternoon, And he will immediately respond. He will call the potential clients himself right away and tell thoroughly evaluate their cases. I highly recommend him and his team of exceptionally talented lawyers and support staff!!!
Mark Ahrens at Todd Miner Law Firm was extremely knowledgeable, helpful, and professional throughout the entire process. He took the time to answer all of my questions thoroughly and made sure I understood every step. I truly appreciated his expertise and would highly recommend him to anyone in need of legal assistance.
My experience in March 2025 with Attorney Todd Miner was very good! His staff, Jennifer was always supportive and helpful, eager to answer questions or concerns. I would highly recommend this attorney office. Blessings continuously to this Attorney office and staff.
Thank you for helping me in the past with the employer who left me in the hospital injured, alone, and unwilling to take care of my hospital bills.
I am writing this review of Todd Miner Law so the public can get a perspective of an actual client’s experience following a car accident. My wife and I were hit by a driver resulting in our car rolling over two times. Medical questions aside, the trauma of the legal aspects after this accident were troubling. Being new to the state of Florida, we had no legal representation. One only has to watch television to see the various alternatives that are available to you. That being said, Todd Miner was the one that showed an interest in assisting us no matter what the possible outcome might be. To be honest, we were sort of lost in all the details that started to arise and needed help. Todd Miner came to the rescue. Attorney, Mark Aherns and his assistant, Stephanie Valez-Raghunandan were terrific in handling all the details that needed solved. My wife and I are grateful for their assistance; without them we would never have been able to reach this point of conclusion. Thank you, Todd, Mark, and Stephanie. We recommend them highly to anyone in need.

Why Should You Hire Our Rideshare Accident Lawyer?

Rideshare 2

Getting injured in an Uber or Lyft crash is different from a regular car accident. These cases involve tricky insurance rules, shifting responsibility, and companies that try to avoid paying. You need the best rideshare accident lawyer to fight for you and handle the details.

At Todd Miner Law, our Orlando rideshare car accident lawyers handle everything from start to finish. We make sure you don’t have to face the insurance companies alone. Here’s why hiring a Lyft or Uber lawyer for a rideshare accident is crucial.

Knowledge of Rideshare Insurance Coverage

Florida has a no-fault system, which covers up to $10,000 for medical expenses and lost wages through Personal Injury Protection (PIP). However, serious injuries in rideshare accidents can quickly cost more than that.

A rideshare injury lawyer understands how Uber and Lyft’s insurance works. The type of insurance coverage depends on whether the driver was offline, waiting for a ride, or actively transporting a passenger. An Uber or Lyft injury attorney will find every insurance policy that applies and make sure you get the right coverage.

Detailed Case Investigation

We don’t rely on incomplete reports or hearsay. At our Orlando rideshare accident law firm, we investigate every case in detail. This includes visiting accident sites, checking road conditions, taking photos of vehicle damage, and gathering black box data when available. We also get surveillance footage from nearby cameras and traffic systems.

At Todd Miner Law, we are experienced rideshare lawyers who work closely with leading accident experts and medical professionals. We collect witness statements early to preserve critical details and build a strong, evidence-backed case. This proactive approach makes it harder for insurance companies to dispute your claim.

Protection Against Insurance Company Tactics

Insurance companies often pressure the victims into accepting low offers. They might downplay your injuries or delay the claims process to make you settle for less.

A rideshare accident lawyer protects your rights and guides you through the legal process. We handle all communication with insurance companies, challenge unfair denials, and push back against low settlement offers.

At Todd Miner Law, our team builds strong cases backed by expert analysis and medical documentation, giving insurers no excuse to delay or underpay your claim.

Holding Uber and Lyft Accountable

It’s not easy to make Uber and Lyft take responsibility. Since they treat drivers as independent contractors, these companies often deny responsibility for accidents.

However, our Orlando rideshare accident lawyers know how to handle this situation. We look at trip data, app information, and driver status during the crash.

If the driver was active on the app, we make sure Uber or Lyft’s $1 million liability coverage applies. Or if another driver caused the crash, we go after their insurance while protecting your rights under the rideshare company’s uninsured motorist policy.

Rideshare Accident Expertise

Rideshare accident cases are not like regular car accidents. They involve multiple insurance policies, tricky legal rules, and Florida’s specific rideshare laws. Many personal injury lawyers don’t have the experience to handle these cases.

At Todd Miner Law, our attorneys specialize in rideshare accidents. We understand Florida’s rideshare laws and know how to hold companies accountable. If Uber or Lyft tries to avoid responsibility, we’re ready to expose their tactics and fight for your full compensation.

Trial-Ready from Day One

While some law firms focus on quick settlements, we treat every rideshare case like it will go to court. This approach makes insurance companies take your claim seriously.

We gather expert testimony, accident reconstructions, and detailed medical records right from the start. If insurers keep stalling or denying your claim, we’re ready to take your case to trial and fight for the compensation you deserve.

After an Uber or Lyft crash, you need more than promises — real results. At Todd Miner Law, our Florida rideshare accident attorneys are here to fight for the full compensation you deserve. Call 407-894-1480 for a free case evaluation today. Get experienced legal help when you need it most.

What If You’re Hit by an Uninsured Uber or Lyft Driver?

Contact Top Uber Accident Attorneys in Orlando Today – Todd Miner LawIf you’re struck by an uninsured Uber or Lyft driver, you may still have coverage options. When a driver is logged into the app or actively transporting a passenger, the rideshare company’s uninsured motorist coverage typically applies to injured parties.

If the driver was off-duty, you might need to turn to your uninsured motorist policy. Promptly report the collision to both the rideshare company and your insurance provider. Additionally, consulting an Uber or Lyft accident attorney ensures your rights remain protected throughout the claims process.

Does Coverage Apply If the Driver Was Off-Duty?

If a rideshare driver isn’t logged into the app, only their personal auto insurance covers any accident. Uber or Lyft policies don’t apply when drivers are completely off-duty, leaving claims to be handled through private coverage alone.

However, once the driver activates the app, even without accepting a ride, limited third-party liability coverage may kick in. If the driver accepts a trip or has a passenger, much higher coverage applies, often providing up to $1 million in protection for injuries and property damage.

Is It Important to Take Photos of the Accident Scene?

Yes, photographs can serve as strong evidence to support your claim, providing a clear visual record of the damage, road conditions, and any relevant factors that may have contributed to the crash.

In addition to photos of vehicle damage, be sure to capture the surroundings. This includes traffic signals, skid marks, and the positions of the vehicles involved. If there are any visible injuries, document them as well to support medical claims. Also, collect witness details and check for surveillance footage to further support your claim.

Can You Sue If You Were Partially at Fault?

Yes, you can still sue if you were partly at fault in an Uber or Lyft accident. Florida follows a comparative negligence law, so you may recover damages, though your compensation is reduced based on your percentage of fault. For example, if you’re 20% at fault, your recovery drops by that amount.

At Todd Miner Law, our experienced team gathers crucial evidence, handles negotiations, and guides you through every step of the legal process. We work tirelessly to secure fair compensation, even when partial fault is involved, giving you the best chance to recover what you deserve.

What If a Manufacturer or a Government Entity is At Fault?

Top Rated Orlando Uber Crash Lawyers – Todd Miner LawSometimes, an Uber accident happens because of a vehicle defect or unsafe road conditions. In these cases, the responsible party may be:

  • Vehicle manufacturer – If faulty brakes, airbags, or steering failures caused the crash, the manufacturer may be liable under product liability laws.
  • A government entity – If potholes, missing traffic signs, or broken signals contributed to the accident, the city or municipality may be at fault.

Remember that in Florida, you have a limited window to file these claims. Hence, make sure to reach out to an Uber accident lawyer promptly to make sure you meet all deadlines and follow the best legal recourse.

What Should You Do Immediately After a Rideshare Accident?

If you’re involved in an Uber or Lyft accident, the actions you take in the moments following the crash can have a significant effect on both your health and your ability to pursue a legal claim. Here’s what you need to do, step-by-step:

  • Check for Injuries

Your health comes first. Immediately check yourself, the driver, and any passengers for injuries. If anyone is hurt or if there is significant damage, call 911 for emergency assistance.

  • Call the Police

Even if the accident appears minor, always contact the police. An official police report provides essential documentation for your claim and can be crucial for any future legal actions.

  • Document the Scene

Use your phone to capture detailed photos of the accident scene, vehicle damage, any visible injuries, road conditions, traffic signs, and other key details. These photos can be vital evidence for your case.

  • Gather Information

Collect the Uber or Lyft driver’s name, contact information, insurance details, and vehicle information. Obtain similar details from the other drivers involved, if there are additional vehicles in the accident. Also, speak to any witnesses and record their contact information.

  • Report the Accident Through the App

Start the claims process as soon as possible by reporting the accident through the Uber or Lyft app. For Uber, go to “Your Trips,” select the ride, and report the crash in the “Help” section. For Lyft, report it under your ride history in the “Help” section. Early reporting can trigger insurance coverage that may apply to your case.

  • Seek Medical Attention

Even if you don’t feel injured right away, it’s important to see a doctor as soon as possible. Some injuries, such as concussions, whiplash, or internal injuries, may not show signs immediately but can worsen over time.

  • Consult a Rideshare Accident Lawyer

Multiple insurance policies and liability issues can make rideshare accidents complicated. An experienced Lyft or Uber accident lawyer can help protect your rights, navigate insurance disputes, and work to get you the compensation you deserve.

Each decision that you take after a crash matters. Let our trusted Lyft and Uber accident lawyers guide you through your next steps and fight for the recovery you deserve. Call Todd Miner Law now at 407-894-1480 for your free, no-obligation consultation.

How Rideshare Accident Lawsuits Differ from Standard Car Accident Claims?

Rideshare accident claims involve distinct challenges compared to traditional car accidents. The nature of rideshare services introduces complexities such as multiple insurance policies, unclear liability, and the involvement of corporate entities like Uber and Lyft as well as the different state laws. Understanding these details is important for anyone involved in an accident while using or riding in a rideshare vehicle.

The following sections will outline the key factors that make rideshare accidents uniquely challenging and why having an experienced Uber / Lyft accident lawyer is essential to navigating these cases.

1. Unique Challenges of Rideshare Accident Lawsuits

Uber and Lyft accident claims are tougher than normal car accident cases. You’ll face more legal hurdles, multiple insurance companies, and corporate pushback designed to protect rideshare company profits, not your best interests.

  • Multi-Party Liability: In a rideshare accident, several parties might be responsible. It could be the rideshare driver, another driver on the road, or even Uber or Lyft itself. Each party typically tries to avoid blame. That’s why a thorough investigation is critical to prove who’s truly at fault and hold them accountable for your injuries.
  • Navigating Corporate Policies: Because Uber and Lyft label their drivers as independent contractors, they try to limit their own legal responsibility. However, if the driver was actively transporting a passenger or on the way to pick someone up, the rideshare company’s insurance should cover your injuries. Knowing how to navigate these company policies is key to getting the compensation you deserve.

2. Complex Insurance Structures in Rideshare Accidents

Insurance coverage in a rideshare crash works differently than in a typical car accident. What insurance applies depends on what the driver was doing at the time of the crash.

  • Shifting Insurance Coverage: If the driver is offline, their personal car insurance covers the accident. When they turn the app on but aren’t transporting anyone yet, limited company coverage applies. The highest coverage only kicks in when a driver is actively carrying a passenger or on their way to pick one up.
  • Coverage Gaps and Overlaps: Depending on the situation, the transition between personal and company insurance can leave gaps in coverage, making it difficult to determine which policy applies to medical expenses, vehicle damage, or lost wages.
  • Complex Claims Process: Multiple insurance companies mean delays, denials, and disputes over who should pay. Each insurer tries to avoid responsibility, which can slow down your claim and reduce your chances of fair compensation without legal help.

These complexities can significantly impact a victim’s ability to secure the compensation they deserve. An Uber or Lyft accident attorney is essential to navigate these shifting policies and ensure that every potential source of compensation is pursued.

Who Can Be Held Liable in an Uber or Lyft Accident Case?

When it comes to rideshare crashes, determining who is responsible isn’t always straightforward. Liability can extend beyond the rideshare driver to include Uber, Lyft, other motorists, and even third parties.

Each party’s involvement directly affects your legal options and determines the compensation you can pursue. Let’s break down the key players and how their involvement impacts your case.

  • Rideshare Drivers

Most rideshare accident claims start by looking at the Uber or Lyft driver. If they were distracted, speeding, or breaking traffic rules, they could be held directly responsible for your crash. But proving this takes more than pointing fingers; you need evidence like witness statements, traffic camera footage, or phone records.

How Driver Negligence Impacts Your Case?

If your rideshare driver caused the accident, you can file a claim against their insurance. If they were logged into the app or had a passenger at the time, additional insurance from Uber or Lyft may also apply. That’s why it’s important to gather proof of their actions and driving status quickly.

  • Rideshare Companies (Uber and Lyft)

Uber and Lyft often avoid blame by calling their drivers “independent contractors.” But if they failed to run background checks, ignored safety violations, or allowed a reckless driver to stay on the road, the company’s negligence could still make them liable for your accident.

This becomes even more important when the driver is actively using the app, whether picking up, carrying a passenger, or waiting for a ride request. In these cases, Uber and Lyft provide up to $1 million in liability coverage. This extra protection can be critical if your injuries are serious or if the driver’s personal insurance is insufficient to cover your medical expenses and other damages.

  • Other Drivers

Many Uber and Lyft accidents involve other vehicles, making it harder to figure out who’s at fault. If another driver ran a red light, was texting, or was driving recklessly, they might be fully or partially responsible for your injuries.

In those situations, you have the right to file a claim against both the rideshare driver, the company, and the at-fault driver’s insurance. By doing so, you strengthen your chances of securing full compensation for your medical costs, lost wages, and pain and suffering.

Fault in Multi-Vehicle Rideshare Accidents

In crashes involving multiple drivers, it’s essential to gather evidence like police reports, video footage, and witness statements from every party involved. This process fairly assigns blame and protects you from covering expenses caused by someone else’s carelessness.

  • Third Parties

Sometimes, it’s not just drivers or rideshare companies who are responsible for an accident. Other parties might also play a role in causing or contributing to a crash. Here’s how third-party liability can come into play:

  • Vehicle Maintenance Providers: If the car involved in the accident had issues like faulty brakes, worn-out tires, or other preventable problems, the mechanic or maintenance company that serviced the vehicle could be liable for negligence.
  • Government Agencies: Dangerous road conditions, such as potholes, broken traffic lights, or missing road signs, can lead to serious accidents. In those cases, the city, county, or government agency maintaining the roads might be liable.
  • Vehicle Manufacturers: If a defective car part, like malfunctioning airbags, steering issues, or brake failure, contributed to the crash, the company that manufactured or sold the faulty part could be legally responsible for your injuries and damages.

How Does Uber and Lyft Insurance Coverage Work?

In Florida, Uber and Lyft insurance coverage operate in clear phases, depending on whether you have a passenger, are waiting for a ride, or are off duty. Because your personal auto insurance doesn’t fully cover rideshare activities, understanding these coverage phases is essential. Here’s exactly how it works:

PhaseWho’s Covered?Type of CoverageKey Details
Phase 1:
App On, Waiting for a Ride
Driver (limited)Personal auto insurance + Limited commercial policy from Uber/LyftMinimal coverage; Uber/Lyft’s policy activates with specific limitations.
Phase 2:
En Route to Pick Up Passenger
Driver (full)Personal auto insurance + Uber/Lyft’s commercial insuranceCoverage applies for bodily injury and property damage.
Phase 3:
Passenger in the Vehicle
Driver and Passenger (maximum protection)Full commercial insurance from Uber/Lyft:
liability, collision, uninsured/underinsured motorist coverage
Protects both driver and passenger for injuries and vehicle damage.

What Insurance Rules Should Rideshare Drivers in Florida Know?

Now that you understand how insurance coverage changes by phase, it’s essential to know a few additional rules that affect your protection while driving for Uber or Lyft in Florida:

  • Mandatory Personal Auto Insurance

In Florida, you must carry personal auto insurance that meets the state’s minimum liability requirements. Even though Uber and Lyft provide some commercial coverage, your personal policy stays active and legally necessary at all times.

  • Limited Commercial Insurance Between Rides

During Phase 1, while waiting for a ride request, Uber and Lyft offer limited commercial insurance. However, this coverage alone isn’t enough for complete protection in a serious crash. That’s why it’s essential to review your coverage details and consider adding more protection.

  • Uninsured and Underinsured Motorist Coverage

Florida follows a no-fault insurance system. This means injured passengers and drivers must use their Personal Injury Protection (PIP) benefits first, regardless of fault. If your accident costs exceed those limits, uninsured/underinsured motorist (UM) coverage from the rideshare company or your own policy can help. At Todd Miner Law, we stress how essential this is, especially in cases involving uninsured drivers.

  • Collision and Comprehensive Coverage

Uber and Lyft provide collision and comprehensive coverage once a passenger is inside the vehicle. However, you should be aware that these policies come with high deductibles. To avoid gaps in protection, having your collision and comprehensive insurance is a smart move.

Why You Need Rideshare-Specific Insurance?

Neither personal auto insurance nor Uber and Lyft’s coverage offers complete protection. That’s why we recommend rideshare-specific insurance. This policy type fills the gaps left by personal and commercial coverage, making sure you’re fully protected on every trip.

When Should You Consider Filing a Lawsuit Against Uber or Lyft?

If you’ve been involved in a rideshare accident and you’re unable to recover adequate compensation through insurance or settlement negotiations, filing a lawsuit may be necessary. Here’s when you should think about taking legal action:

  • When Insurance Denies Your Claim

If Uber or Lyft’s insurance provider denies your claim or refuses to cover the full extent of your damages, filing a lawsuit may be the next step. Insurance companies often try to minimize payouts. If negotiations fail, taking legal action may be the best way to secure full compensation for your injuries and financial losses.

Common reasons insurance may deny your claim include:

  • Insufficient evidence: They argue that you lack proof of the driver’s fault or your injuries.
  • Disputes over fault: They claim you were partly or entirely at fault for the accident.
  • Policy exclusions: They state that certain damages or circumstances aren’t covered.
  • When Uber or Lyft Denies Liability

If Uber or Lyft denies responsibility for the accident, it can feel discouraging, but a denial doesn’t mean your case is over. Gathering additional evidence or negotiating further may help you challenge their position. You can also consult with a Lyft  & Uber crash lawyer who can review your case, build a stronger argument, and help you pursue the compensation you deserve.

  • When Insufficient Settlement Offers Are Made

Sometimes, the insurance company offers a settlement, but it may not fully cover all your expenses. If you believe the offer doesn’t reflect the true value of your damages, you should consider pursuing a lawsuit rather than accepting a low settlement.

Signs of a low settlement offer include:

  • Medical expenses are not fully covered: Offers that ignore future treatments or therapies are inadequate.
  • Lost wages are overlooked: Any time missed from work and future earning potential must be included.
  • Long-term care needs are ignored: If you require surgeries, rehabilitation, or lifelong care, the settlement should reflect those costs.
  • Emotional distress is dismissed: Emotional suffering, pain, and future mental health care should also be considered.
  • Clear Evidence of Negligence

If there is obvious evidence of negligence by the Uber or Lyft driver, the rideshare company itself, or a third party, you may have a strong case for filing a lawsuit. Negligence can include reckless driving, distracted driving, or even the company’s failure to screen and supervise drivers properly.

If you’ve been injured in a rideshare accident and need help with insurance claims or a low settlement, Todd Miner Law is here for you. Contact us today for a free consultation and let our experienced team fight for the compensation you deserve.

What Damages Can You Recover in a Rideshare Accident?

After a rideshare accident, you can pursue compensation for a wide range of damages. However, these typically fall into three categories: economic, non-economic, and sometimes punitive damages, depending on the severity of the case.

Economic Damages

You receive economic damages to cover tangible financial losses that you can easily measure and document. Usually, these damages rely on actual expenses you’ve paid or losses you’ve faced directly because of the accident.

Therefore, they play a vital role in maintaining your financial stability throughout your recovery. Economic damages are essential to help cover recovery costs and financial stability after an accident.

  • Medical Bills and Future Care Costs: Compensation for medical expenses includes costs for immediate care such as hospital stays, surgeries, and rehabilitation. It also accounts for future medical treatments, including ongoing therapies, medications, or surgeries needed for your long-term recovery.
  • Lost Wages and Lost Earning Capacity: When your injuries keep you from working, you can recover compensation for lost wages during the time you missed. Furthermore, if your injuries affect your earning potential in the future, such as limiting your ability to perform your job or requiring a career change, you can recover damages for lost earning capacity.

Non-Economic Damages

You recover non-economic damages to address the emotional, mental, and physical hardships you experience after an accident.  These damages are less tangible and harder to quantify, but are just as critical to a fair recovery. Non-economic damages account for the suffering that goes beyond financial loss.

  • Pain and Suffering: This includes compensation for both the physical pain and discomfort you experience because of the accident. Pain and suffering damages can account for immediate injuries as well as long-term pain or chronic conditions that affect your quality of life.
  • Emotional Distress: Accidents can take a serious emotional toll, affecting your daily life and overall well-being. Therefore, emotional distress damages may be awarded for issues like anxiety, depression, PTSD, and other mental health concerns triggered or worsened by the accident. The emotional impact on your life, such as changes in mood, sleep disruptions, or other psychological symptoms, is considered.

Special Damages for Severe Injuries

For more serious injuries, additional special damages can be awarded to address the long-term effects that can result from significant harm. These damages consider how severe injuries can impact your daily life and ongoing needs.

  • Long-Term Disability and Rehabilitation Costs: In cases of severe injury resulting in permanent disability, you may receive compensation for long-term rehabilitation and ongoing medical care. Additionally, this can cover necessary lifestyle changes, such as home modifications or personal care assistance, helping you manage daily life more comfortably.
  • Wrongful Death Claims: If the accident results in a loved one’s death, surviving family members may be entitled to compensation. This can cover funeral expenses, loss of companionship, and the loss of financial support that the deceased person would have provided to the family.
  • Impact on Quality of Life: Permanent injuries can significantly reduce your ability to enjoy daily activities and participate in life as you once did. Therefore, compensation for the impact on your quality of life addresses the losses related to hobbies, family interactions, and general life enjoyment that are now limited by your injuries.

Punitive Damages

Punitive damages are awarded to punish reckless or malicious behavior, such as drunk driving or gross negligence by the driver or rideshare company. Unlike compensatory damages, they aim to deter similar future behavior.

FAQs - Uber Accident Lawyer Orlando

Yes, as a passenger, you have the right to file a lawsuit if you’re injured in an Uber accident. Rideshare companies are responsible for ensuring safety, but your claim might involve both the driver’s insurance and the company’s coverage, depending on the circumstances.

Uber and Lyft may be held responsible for their drivers’ actions under certain circumstances, such as when the driver is actively working or when the company’s negligence contributed to the accident.

If another driver caused the accident, you can pursue a claim against that driver’s insurance and potentially also claim from Uber or Lyft insurance if the driver was logged into the app.

In Florida, you typically have two years from the date of the accident to file a personal injury claim. It’s crucial to file promptly to avoid missing out on compensation due to the statute of limitations.

Riders can’t directly access Lyft’s internal reports. However, Lyft attorneys or law enforcement can request key evidence through the Lyft Law Enforcement Portal during a claim investigation.

To maximize your compensation, always report the accident immediately and gather all essential evidence. Then, file your Uber accident claims through the app without delay. Moreover, working with an experienced Uber accident law firm and the best lawyer to sue Uber ensures every part of your case is carefully handled, giving you the best chance to recover the full compensation you deserve.

If your Uber crashes, first check for injuries and call 911 right away. Next, gather the driver’s details and insurance information, and take photos of the scene. Then, report the incident through the Uber app. Additionally, contact an experienced Uber accident attorney to handle your Uber claims and protect your rights, since these cases often get complicated.

If your Uber driver crashes, your safety is the top priority. Uber’s insurance may cover your injuries depending on the driver’s status at the time of the crash. However, report the accident immediately through the Uber app and seek medical attention, even for injuries that seem minor.

Uber’s insurance usually doesn’t cover rental cars unless the rental is approved and listed on your driver profile. Even then, coverage applies only when you’re logged into the Uber app and actively working. Therefore, always review Uber’s latest insurance terms and your rental agreement to confirm exact coverage details.

Liability depends on who caused the accident and the driver’s activity within the Uber or Lyft app. If the rideshare driver was at fault and logged in, Uber’s insurance may apply. On the other hand, if another driver caused the crash, their insurer may be liable.`Therefore, always document the scene and consult legal counsel promptly.

If an Uber driver hits your car, you should gather evidence, call the police, and report the accident. Uber’s insurance may cover your damages if the driver was active on the app during the crash. You can also file a claim through the driver’s personal insurance.

To sue Uber and Lyft, begin by speaking with an experienced Uber & Lyft accident lawyer who is familiar with rideshare laws. A qualified Lyft and Uber crash attorney can help you gather evidence, assess your claim, and file suit if needed. In some cases, authorities may request trip records through the Uber or Lyft Law Enforcement Portal for investigation.

If an Uber driver reports you, Uber may review the incident and could temporarily suspend or deactivate your account based on their findings. However, if you believe the report was false, you can appeal through Uber’s support system and provide your side of the story for review.

Yes, you can sue Uber for a car accident under certain circumstances. If you are injured while being transported or if an Uber driver causes an accident, Uber’s insurance may be responsible. Filing a lawsuit may be necessary if insurance negotiations fail or liability is disputed.

Uber generally does not automatically report accidents to your personal insurance. However, Uber’s own insurance providers are involved once you file a claim through the app. If you’re a driver, your personal auto insurance might find out if you are involved in an accident while driving for Uber.

To file a claim with Uber insurance, open the Uber app, go to “Your Trips,” select the relevant ride, and report the incident under the “Help” section. Early reporting is crucial. Uber’s insurance team will then review your case and determine coverage based on the circumstances.

Uber or Lyft shares responsibility when the driver is logged into the app and actively working. If the driver causes an accident during a ride or while en route, the company’s insurance typically covers damages. However, when the driver is off-duty, personal coverage applies. Therefore, both the driver’s and the company’s policies may apply, depending on the situation.

If the rideshare driver is found liable, Uber or Lyft’s insurance may cover your injuries and damages if the driver was active on the app. Conversely, if they were off-duty, their personal insurer may bear responsibility. In any case, act quickly by collecting evidence and contacting an attorney to preserve your legal options.
